Attorney Beres has appeared in numerous jury and bench trials, arbitrations, mediations and administrative hearings throughout the state.  She has written briefs submitted to Wisconsin’s circuit courts, Courts of Appeals and Supreme Court, as well as federal district courts and the Seventh Circuit Court of Appeals. She has argued before the Wisconsin Court of Appeals.

Attorney Beres has represented health care defendants in cases involving a diverse array of patient care specialties, including cardiology, neurosurgery, nursing, obstetrics and wound care.  She has advocated for manufacturers of products ranging from consumer products to industrial equipment.  She advises clients regarding non-suit and pre-suit insurance claims according to the laws of the various states throughout the country where the claims are filed.

Attorney Ertz has tried as either first or second chair more than ten cases to successful jury verdict in both Minnesota and Wisconsin.  She has successfully briefed and argued cases to both the Minnesota and Wisconsin appeals courts.  The following are samples of her published opinions:

  • Laufman v. Safeco lns. Co., 833 N.W.2d 873 (Wis. Ct. App. May 21, 2013) The Wisconsin Court of Appeals affirmed the circuit court’s decision granting the insurer’s motions for declaratory, or in the alternative, summary judgment. The litigation concerned a dam owned by the insured, which required reconstruction or abandonment due to its noncompliance with federal licensing standards. The appellate court agreed with the insurer’s position that coverage was excluded under the policy provisions. The court held that insured’s “intentional” conduct of electing to do nothing to rectify the issues with the dam did not constitute an “accident” under the occurrence based policy. Accordingly, any damage arising out of the insured’s decision to abandon and remove the dam was intentional conduct that was not covered under the policy.
  • Olson v. Warm Prod., lnc., No. A12-2226, 2013 WL 3779323 (Minn. Ct. App. July 22, 2013)(unpublished opinion). ln a wrongful death suit stemming from the strangulation of an infant on the inner lift cord of a homemade roman shade, the Minnesota Court of Appeals held that the shade was a permanent improvement to real property because they were permanently mounted to the wall for more than 14 years, had never been removed, added capital value, and required extensive assembly and installation. ln finding that window coverings can be permanent improvements to real property, the court held that the plaintiff’s claims were precluded under the statute of repose.
  • Mercado v. Charter Oak Fire Ins. Co., No. 13-CV-124 (Jan. 29, 2014) Following an injury suffered by the plaintiff, a spectator at a horse race on the insured’s private property, the insurer moved for declaratory and summary judgment arguing coverage was precluded because horse races were outside the scope of the farm/ranch insurance policy. The insured indicated on all relevant applications that she operated a private horse farm, and competitive racing activities, as well as business activities, would not be conducted on the property. ln direct opposition to her statements the insured conducted regular, public horse races for profit. As such, coverage was precluded under the Use of Livestock or Other Animals Exclusion and the Business Pursuits Exclusion.

  • Tried cases to jury verdict in Ashland, Milwaukee, Oneida, and Waukesha counties
  • Involved in more than 25 Wisconsin appellate matters, including published decisions in Peterson v. Arlington Hospitality Staffing, Inc., 2004 WI App 199, 276 Wis. 2d 746, 689 N.W.2d 61 (no exception to the exclusive remedy provision of the WCA for a claim by an employee against an employer for negligent hiring, training, and supervision when the injury was a sexual assault committed by a co-employee); and B & D Contractors, Inc. v. Arwin Window Systems, Inc., 2006 WI App 123, 294 Wis. 2d 378, 718 N.W.2d 256 (“your product” exclusion barred coverage despite contention about frames collapsing and causing glass to break)

Verdicts and Published Decisions


I have litigated cases throughout Wisconsin and have represented clients in cases from Kenosha County in the southeast region of Wisconsin to Superior in the northwestern region of the state.  I have tried cases in both state and federal court involving a wide range of issues including products liability, environmental contamination, breach of contract, bad faith, premises liability, insurance coverage, automobile liability and animal liability.  These trials have included claims for personal injury, lost wages, breach of the insurance policy, lost profits and punitive damages.  I have also been involved in appellate actions involving all Wisconsin appellate courts and the federal appellate courts.  In addition to many unpublished rulings, my reported decisions include:

  • Lucterhand v. Granite Microsystems, Inc., 564 F.3d 209, (7th Cir. Ct. 2009), in which we successfully argued on behalf of an insurance company that the intentional acts of an employer against their employee, including retaliation and false imprisonment, were not covered by the insurance policy.
  • Warr v. QPS Company, 298 Wis. 2d 440, (Ct. App. 2006), in which the Wisconsin Court of Appeals analyzed the potential liability of a staffing agency if one borrowed worker injures another borrowed worker during the course and scope of their employment.
  • Jares v. Ulirch, 266 Wis. 2d 322, (Ct. App. 2003), in which the court addressed the scope of the duty to defend and duty to indemnify for damages allegedly caused by a raccoon infestation at a residential home.
  • Rosin v. Fort Howard Corp., (Ct. App. 1998), in which the court prevented a child from recovering for negligent infliction of emotional distress after learning of his father’s death through indirect means.
